DISTANCE SALES AGREEMENT

ARTICLE 1 – PARTIES

ARTICLE 2 – SUBJECT

The subject of this agreement is the determination of the rights and obligations of the parties, in accordance with Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts, regarding the sale and delivery of the product/service ordered electronically by the Buyer through the www.section.gg website.

ARTICLE 3 – PRODUCT, PAYMENT AND DELIVERY

3.1 Product Information

The type, quantity, sales price (VAT included), payment method and delivery information of the goods/services that are the subject of the order are set out in the information displayed and confirmed during the order.

3.2 Payment

●       Payment can be made by credit card, debit card or wire transfer/EFT methods.

●       Differences arising from bank campaigns and installments are the responsibility of the bank.

●       In installment transactions, interest and default provisions are subject to the credit card agreement between the Buyer and the bank.

3.3 Delivery

●       The product is delivered within 30 days at the latest from the confirmation of the order.

●       Delivery is made to the Buyer's address through the contracted courier companies.

●       Unless otherwise stated, delivery costs are borne by Section.

3.4 Return Procedure

●       For payments made by credit card, the refund is made by the bank to the Buyer's account.

●       Section does not make cash refunds; the bank's procedures apply.

ARTICLE 4 – RIGHT OF WITHDRAWAL

●       The Buyer may exercise the right of withdrawal within 14 days from the date of receiving the product, without showing any reason.

●       For the right of withdrawal, a written notification (e-mail/KEP) must be made to Section.

●       Exceptions to the right of withdrawal:

○       Custom-made products,

○       Products that are not suitable for return for health and hygiene reasons,

○       Perishable products,

○       Software, digital content, headphones and similar products whose packaging has been opened.

ARTICLE 5 – GENERAL PROVISIONS

1. The Buyer declares that, before placing the order, they have read and accepted all preliminary information.
   
   
2. The product is delivered complete, free of defects, and in accordance with the characteristics specified in the order.
   
   
3. If the order price is not paid or is canceled in the bank records, Section's delivery obligation does not arise.
   
   
4. If, after delivery, the bank does not make the payment to Section due to unauthorized use of the credit card, the product must be returned by the Buyer.
   
   
5. In the case of a defective good, the Buyer may exercise one of the following rights: withdrawal from the contract, price reduction, free repair, or replacement of the product with a defect-free equivalent.
   
   

ARTICLE 6 – PROTECTION OF PERSONAL DATA

The personal data of the Buyer will be processed solely for the purpose of fulfilling the order within the scope of KVKK (Turkish Personal Data Protection Law No. 6698), will not be shared with third parties, and will be stored within the framework of the relevant legislation.

ARTICLE 7 – DISPUTES

In disputes that may arise from this agreement, the Consumer Arbitration Committees shall have jurisdiction within the monetary limits; for matters exceeding such limits, the Istanbul Anatolian Commercial Courts and Enforcement Offices shall have jurisdiction.

ARTICLE 8 – ENTRY INTO FORCE

By placing an order through www.section.gg, the Buyer is deemed to have accepted all the provisions of this agreement.
